Justice for Windrush Generations is an independent social justice organisation working with partners to highlight the failings of the Windrush Scheme

This strategy is based on ongoing work started over two years ago.

Justice For Windrush Generations, has been hosting Bi Monthly Rally/Lobby in Parliament bringing MPs and the Windrush Community together to focus Parliament’s attention on the failings of the Windrush Scheme ( WS) and seek improvements in order that necessary action is taken by Parliament resultibg to a scheme that is fit for purpose.

Justice For Windrush Generations, the view is that issues started in parliament, and the solution is within the Houses. Hence, our approach is to bring the community to Parliament, where they will air the challenges they face with the WS and eliminate any chance of Parliament being unaware of the major failings.

Our aim is to identify all those that have been impacted by the Home Office’s Hostile Environment and have the Home Office put them back in the position they would have been had the Home Office not wronged them.

We need parliament to make the Home Office do what it is supposed to, which is to reinstate immigration statuses and compensate victims of the Home Office who have disprortionately targeting the Windrush Generation and their descendants for decades.

Chair: Patrick Vernon Windrush

JFWG’s aim is to get justice for the Windrush generation and their descendants who for decades have been wronged by the Home Office. For decades the Windrush Generation and their descendants have been disproportionately, and extensively impacted by the Home Office’s discrminatory policies, their incompetence and maladministration.

We are returning to the House of Commons on 24 January 2024, at 17:00 with the same aim and purpose, which is to get Parliament to do what it is supposed to do, which is get the Home Office to do what should be done. Whic is to put all those wronged in the position they would have been had the Home Office not wronged them. This included the so-called “Barrel Children” (those children that were left behind when their parents migrated to the UK). “Consideration should be given to all those wronged, whether they are in the UK or stranded abroad”.

The above *WINDRUSH* event will in room 5 in the House of Commons.

Hope to see you there!

Some areas of concern – but not exhaustive – include: –

– The slow progress in repairing the damage caused by ‘Home Office’s scandal’. We want everything possible done to ensure the victims and their families receive full citizenship rights, compensation and an all-party committee be established to examine the failure of Members of Parliament to hold Ministers and the Home Office to account.

– The Windrush Scheme is very UK centred and not enough thought was given to those outside that were impacted by Home Office’s actions and policies that impacted the WGD

– Over the past months the scope of the scheme has been narrowed , making it extremely difficult for those outside the UK to be compensated and have their status reinstated.

– The Home Office has stated in their guidance notes that the difficulties of provision of historical document would be given due consideration, and yet they continue to demand of the applicants documentations that they know she/he cannot obtain

– Those outside the UK are having unrealistic demands being made in relation to ‘ties’ in the UK, before returning visas are issued, instead of the Home Office disclosing information held by them in order to help the Applicant.

The WGD need to have their status reinstated and compensated much quicker, and could be if the Home Office is honest and forthright from the outset and mindful of:

– The impact of the Home Office action on the WGDs such as;- WGD losing their Indefinite Leave To Remain (ILR)

– This ra rally takes place in the House of Commons from 17:30 – 2000hrs.

——————————————————————————–The ‘Windrush generation’ refers to Commonwealth nationals who settled in the UK before 1973. The Immigration Act 1971 provided protection for Commonwealth citizens if they have lived here for more than five years and if they arrived in the country before 1973. The Act provided that those here before it came into force should be treated as having been given indefinite leave to enter or remain in the UK, as well as retaining a right of abode for certain Commonwealth citizens. Therefore everyone that arrived in the UK before 1973 was given settlement rights and was not required to get any specific documentation to prove those rights.

It has been confirmed that:

anyone from the ‘Windrush’ generation can become a British citizen

the free citizenship offer will apply not just to the families of Caribbean migrants who came to the UK between 1948 and 1973 but anyone from other Commonwealth nations who settled in the UK over the same period

the Government will waive fees for British citizenship applications both for the Windrush generation and their children, both to those who have no current documentation, and also to those who have it

non-Commonwealth citizens who settled in the UK before 1973 and people who arrived between 1973-88 who have an existing right to be in the UK are not expected to pay for the documentation they need to prove their indefinite leave to remain. Confirmation of existing British citizenship for children born to the Windrush generation in the UK also can be given where needed free of charge.

the knowledge of language and life in the UK test will not be required or attendance at a citizenship ceremony.

any charges for those returning to the UK for those who had retired to their countries of origin after living in the UK would also be removed, with further work with our embassies and high commissions around publicising this offer

the information shared via the taskforce will not be used to deport individuals, with the aim to help resolve cases as soon as possible

those applying for citizenship under the scheme will not need to meet the good character requirements in place for all citizenship and those who are looking to return to the UK having spent recent years in their home countries should receive assistance, free of charge.
